Cattany <br />Division Director <br />Natural Resource Trustee <br />The Division of Minerals and Geology has completed review of the Discharge <br />Monitoring Reports for the 1Sf 2nd and 3`d quarters of 2004 for the New Elk Mine. <br />No discharge was reported during the 1st quarter, which is consistent with field <br />inspection. Discharge was reported from the outfall at pond 8 on two occasions in the <br />2nd quarter due to storm events and/or snowmelt. Samples appear to have been taken <br />within the 48-hour period when a storm exemption can be accepted. <br />• Please explain the sample values reported for settleable solids from the <br />lab sheets and explain the meaning of the lab codes "UH and BH". <br />Discharge was again reported in the 3`d quarter from the outfall at pond 8 from two <br />rainfall events. A storm event that occurred on the afternoon and evening of July 26 <br />totaled 3.0 inches of rain as measured in a rain gauge on the pond 8 embankment. The <br />discharge from the pond was sampled on July 29 at 12:15 in the afternoon. The <br />alternate effluent limits for a storm greater than the 10-year, 24-hour storm event is <br />requested. <br />This sample appears to have been taken outside of the 48-hour window <br />following the end of the storm event(s). Please explain how this sample is <br />eligible for a storm exemption. <br />Another storm event occurred in the 3`d quarter on August 7. The rain gauge at pond 8 <br />indicated .35 inches of rain fell during that storm event.
