Cottony <br />DIVISIen Dlrec[or <br />Natural Resauroe Trustee <br />The Division received your adequacy response to the Division's December 13, 2005 letter regarding the <br />new permit application for the Wattenberg West Sand and Gravel Mine, File No. M-2005-066. The <br />Division has a number of remaining items that need to be addressed prior to approval of the application. <br />Rule 6.4.3 Exhibit C- Pre-Minine and Minim Plan Maps <br />1. The applicant states that access roads to oil and gas facilities may be relocated within the properly if <br />agreed to by the facility operator(s). Please be aware that the owners/easement holders of the roads <br />will need to consent to relocation of the road in the form of a notarized consent agreement. If not <br />included during the review of this application, it must be submitted in the form of a revision to the <br />permit. As an alternative, the applicant can commit to maintaining a 200-foot mining off set distance, <br />or provide an engineering evaluation to mine closer than 200 feet. <br />Rule 6.4.7 Exhibit G-Water Information <br />2. Attached, please find addition questions on the hydrology review of the site. <br />Rule 6.4.10 Exhibit H-Wildlife Information <br />3. The applicant suggests that mining in the southwestern portion of the site commence once the <br />burrowing owls have left for the winter. The applicant commits to not commencing stripping in <br />Phase 1 until the burrowing owl has left fot the winter, which typically will happen in October. <br />Please specify a date in October in which the applicant will not begin the stripping of material in <br />Phase I. <br />Rule 6.4.10 Exhibit J- Vesetation Information <br />4. Rule 6.4.10 requires the applicant to depict the relation of the types of vegetation to the existing <br />topography on a map in Exhibi[ C. The applicant provided information that wetlands exist on site <br />{aeeas A, B and C}. The Division understands that these areas were determined to benon- <br />jurisdictional.
