Goedert <br />630 J Street <br />Penrose, Colorado 81240 <br />Re: Colorado Division of Highways - "Nordyke Pit" - File No. M-85-040 <br />Legal Description: E 1/2 NE 1/4, Sec. 5, T24S, R71W of 6th P.M. <br />Dear Mr. Goedert: <br />Our Division has received the copy of your letter of protest to Custer County <br />concerning the above captioned proposed gravel operation. Please advise our <br />Division if this is to be considered a protest to the Mined Land Reclamation <br />Board as concerns the granting of a mining and reclamation permit to the <br />Division of Highways for this operation. Such a protest must be received at <br />our Division office by no later than twenty (20) days after the last date of <br />publication by the Division of Highways. Our Rules and Regulations require <br />four sequential weeks (once per week) of publication by the applicant in a <br />local newspaper for a regular operation such as this. <br />Please be advised that any protest of this operation must be based on <br />provisions found in our Rules and Regulations. You may get a copy of these <br />Rules and Regulations by sending us a check for X2.00 accompanied by a request <br />for the Rules and Regulations for Minerals. In general, our Board has <br />jurisdiction over environment issues (e.g., a workable reclamation plan and an <br />environmentally safe mining plan), and defers to counties in matters of land <br />use (e.g., traffic, noise, property values, etc.). I suggest that you analyze <br />your reasons for objecting to this proposed mining operation and then protest <br />to the appropriate agency. <br />A copy of the mining and reclamation permit application for this site is <br />required to be placed at the Custer County Clerk's office. You may review <br />this application to become familiar with the plans as submitted to us. Our <br />files in this matter are also open for your review. <br />The application is now scheduled for consideration by the Mined Land <br />Reclamation Board during the May 22-23, 1985 meeting. This meeting is to be <br />held in Room 100 of 1313 Sherman, in Denver, and will commence at 9:00 a.m., <br />each day.
