The Permittee, Marlyn E. Vazquez, Bruce A. Diamond desires to conduct a mining operation <br />lmawn as Pit Number One, for the purpose of extrac[irrg sand and gravel. The Pemritree will nd mine any <br />secondary commodities. <br />B. On October 16, 2000 the Mined Land Reclamation Board (the "Board's approved the <br />Pernitree's application for this permit, fixed the amount of the financial wartarrty and directed that this permit be <br />issued upon the filimg with the Division of Minerals and Geology (the "Division") of perfomrance warranty and <br />financial warranty (or warranties) in the amoumt so fixed ur four and subst~ce approved by the Division. Said <br />warranties have bear filed with the Division. <br />C. If the Pemrit2ee desires to extract materials dher than those listed in (A), a separate pernrt may <br />be required. <br />D. On October 16, 2000 the Board made the following findings: <br />I . The application for this permit complies with the requirements of the Colorado Mined <br />Land Reclamation Ad for the Extraction of Construction Materials, C.R.S. 34-32.5-101 et se~C ., as amended, and <br />with all applicable local, state and federal laws; <br />2. The operation will mat adversely affect the stability of any significant, valuable, and <br />pernanerrc man-made structure located witlrin two hundred feet of the Affected Land, except. where there is an <br />agreemerrt betwcen the Operstor and the persons having an interest in the structure that damage to the structure is <br />to be compensated for by the Permittee; and; <br />
