Long <br />Division Dne~lo~ <br />THIS PERMIT is issued by the Mined Land Reclamation Board, Departrnent of Natural Resources, <br />State of Colorado. <br />RECITALS <br />A. The Pemrittce, Bent Courrty desires to conduct a mining operation lmown as Bart County Pit # <br />2, for the purpose of extracting gravel. The Pemtittee will not mine any secwdary commodities. <br />B. On 1Lme 22, 2001 the Mined Land Reclamation Board (the "Board") approved the Pemtittee's <br />application for this pemtit, fixed the amourn of the financial warranty and directed that this permit be issued upon <br />the filing with the Division of Minerals and Geology (the "Division") of performance wartarrty and financial <br />wartarrty (or wartanties) in the amount so fixed in Porn and substance approved by the Division. Said warranties <br />have been filed with the Division. <br />C. if the PemLittee desires to extract materials other than those listed ur (A), a separate permit may <br />be required. <br />D. On June 22, 2001 the Board made the following findings: <br />1. The application for this permit complies with the requiremarts of the Colorado Mined <br />Land Reclamation Ad for the Extraction of Construction Materials, C.RS. 34-32.5-10] et sue., as amended, and <br />with all applicable local, state and federal laws; <br />2. The operation will nd adversely affect the stability of any significant, valuable, and <br />permanent man-made structure located within two hundred fed of the Affected Land, except where there is an <br />agreemart between the Operator and the persons having an interest m the structure that damage to the structure is <br />to be compensated for by the Permittce; and; <br />
