First, this <br />lease will continue until January 1, 2009 at which time paragraph 2 of the <br />agreement indicates it is to be renegotiated. Secondly, the lease specifies <br />that 5 acre-feet will be provided to Park County for general purposes, while <br />another 6 acre-feet is provided for a road construction project (CR77) for the <br />year 2007. This totals ii acre-feet. There is another 5 acre-feet that the <br />Park County could lease in addition to the 11 acre-feet, if it is needed, <br />pursuant to the provision at the top of the second page of the lease. This 5 <br />acre-feet for general use is more than enough to cover the 2 acre-feet of <br />depletions from the Ansley Flat Pit. Thus, the Upper South Platte Water <br />Conservancy District confirms that it will make up to two acre feet per year <br />available to replace depletions from the pit for water years 2007 and 2008. <br />Sincerely, <br />~~~- <br />Stephen A.
