. • • . y ` • ~~~SC~ CONTRACT h l This Agreement made and entered into this ,~~ day of /'/(~ ~/ , 1972, by and betcaeen DAVID PRATHER and VIRGINIA 2R=,TFiER, hereinafter called Prather, and the BOARD OF COUNTY C0,~~5ISSIONERS, I ~ OF' RIO 3LANC0 COUNTY, hereinafter called the Board. i • WITNESSETft: That for and in consideration of the premises, the parties agree as'follows; to-wit: , 1. Prather agrees to sell to the Board, gravel from his z~ ' gravel pit, located in Sec. z"'2', T1S, R92W, for an agreed sum of five cents a cubic yard. In addition, as further compensation for said gravel, the county shall build 'and construct a new approach for the ~ road to said gravel pit and shall install a permanent cattle guard. 'Phe IIoard further agrees to blade the road inter Prather's camp lo- Gated on said property and to gravel said road with excess gravel which has been determined to be not suitable for use by the County. 2. The Board agrees to pay for said gravel at the above rate and to keep records of all gravel removed from said property and to keep the records open for inspection by Prather at any reason- able time. Said gravel pit shall be fenced and locr.ed by said Board and shall not be opened to the general public. Payment for said gravel shall be paid quarterly each year. 3. The Board agrees that upon completion of its use of i said gravel pit, it will level the main area of the pit and leave ~ all o~ to side slopes in such condition, that eznsion will not be a nrc~lem. The Board furtP,er agrees that while they are using said gravel pit, they will spray the gravel pit area to keep weeds under control. i 4. The Board further agrees that it will destroy no more foliage or trees than is absolutely necessary to remove the gravel. i i
