CF ASE A1~iD DESIST C~UFB P?:D CLF.l~N-UP ORDER <br />Based upon the foregoing Findings of Fact and Notice of 'violation, <br />and pursuant tc ±he provisions of 25-8-605 to 607, C. F.. S. (].982), T hereby <br />order you to: <br />1. immediately take whatever measures necessary to Cease and Desist <br />violating the [dater Ovality Control Act, 25-8-101 to 703, C.R.S, (1982 and <br />1985 supp.) and regulations and standards promulgated thereto; <br />2. either clean up and properly dispose of the sludge in any and all <br />ponds affected by the use of flocculant, or submit a detailed report <br />demonstrating that the sludges in these ponds are non-toxic and do not pose <br />any threat to aquatic life; <br />3. inform the Division, in writing, within 15 days of receipt of <br />this Order, of the alternative you have selected in response to paragraph 2 <br />above; <br />4. submit to the Division, in writing, caithin 3G days of receipt of <br />this Order, a plan describing immediate and long term measures to comply with <br />the Act and regulations promulgated thereto; <br />5. within 30 days of receipt of this Order, you are to sample the <br />effluent being discharged from outfall 002 and sample the minewater prior to <br />entering the 002 pond system and have acute biomonitoring tests run on both <br />samples. The tests are to be run according to standard test procedures; <br />6. submit to the Division within 45 days of receipt of this Order, <br />the laboratory results of the biomonitoring described in paragraph 5 above; <br />7. submit to the Division, in writing, within 7 days of receipt of <br />this Order, a statement of your intent to comply. <br />-4- <br />
