<br />1. Gerhard P, Brauer and Anna A. Brauer on October 31,
<br />1952, executed their lease as lessors, and delivered said lease to the
<br />Robinson Brick and Tile Cargrany, a Colorado corporation, as lessee,
<br />said lease as recorded in Book 1362, Page 141, of the records of E1
<br />Fasv Comity, Colorado, which lease covers the following described real ..

<br />Tire East half (E~) of Section @; the South half ~'
<br />(S~) of Section 9; the Southeast quarter (SE>I),
<br />the North half (N~) of the Nortln.+est quarter
<br />(NW(t), and the Southwest quarter (Swi) of the
<br />Northwest quarter (NWT) of Section 171 all in
<br />Township 12 South, Range 62 West of the 6th P.M.,
<br />containing 920 acres, more or less
<br />together with all rights, privileges and appurtenances incident
<br />thereto, hereinafter call "the leasehold interest", and Rudolph Brauer
<br />acid Elsie Brauer are the successors in interest to Gerhard P. Brauer
<br />and Anna A. Brauer irr and to the above described real property. '
<br />2. 1'tiat the above lease was assigned by the Robinson Brick
<br />and Tile Company to A.P. Green Fire BricY. Ca~pariy by Assignmsnt daked
<br />July 23, 1959, recorded in Book 1803, Page 342, of the records of E1
<br />Paso County, Colorado. ''
<br />3. That A.P. Green industries, Inc., hereinafter "Green",
<br />is tl~e successor to A.P. Green Fire Brick Ccn~arry.
<br />4. 'i'liat Green as Lessee subsequently subleased its
<br />leasehold interest to Robinson Brick, Sublessee, by lease recorded in
<br />Book 1803, Page 334, of the records of E1 Paso County, Colorado, which
<br />sublease leas expired:
<br />5. Tlrat said leasehold interest was assigned by Green to
<br />11ie Summit Pressed Brick and Tile Cortgany, a Colorado corporation, on
<br />January 2, 1990, which assigimient was recorded in Beck 5705 at Page 56
<br />of the E1 Paso Comity, Colorado records.
