The decision of the State Engineer shall not create any presumptions, shift the burden of
proof, or serve as a defense in the pending water court case or any other legal action
that may be initiated concerning the substitute water supply plan. This decision shall not
bind the State Engineer to act in a similar manner in any other applications involving
other plans or in any proposed renewal of this plan. Any appeal of the decision made by
the State Engineer concerning this substitute water supply plan pursuant to 37-92-308(4)
shall be to the division water judge within thirty days of the date of this decision and shall
be consolidated with the application for approval of the plan for augmentation.
