• MI\'ED .....,., ....999 .,.,. ~..., BOaRI~ <br />• +-' Department of :3atural Resources <br />1313 Sherman Street, Rooa 423 . <br />Denver, Colorado 80203 <br />Permit Yo. 80-135 <br />Telephone: 839-3567 <br />DEVELOPMENT AVD E~TRaCTION MI.']IVG PER"[IT <br />THIS ?ER`1IT is issued this 7th day of October, 1980 by the :tined Land <br />Reclamation Board, Department of Natural Resources, State of Colorado. <br />W I T N E S S E T H <br />[v1'.EREaS, GALEN & THELMA JEAN HEADLEY desires to conduct a(n) open mining <br />operation, knocan as Headley Farms for the purpose of extracting open <br />mined sand E gravel; and, <br />[dHEREAS, on July 2 19 80, GALEN & THELMA JEAN HEADLEY "FILED" an <br />aoolication,a reclamation plan and map, and the required fee, as required by law; and <br />!T1IEREAS, on August 27 19 80, the Pined Land Reclamation Board approved <br />GALEN ~ THELMA JEAN HEADLEY application and set bond; and <br />WHEREaS, on October 7 19 80, the :fined Land Reclamation Board accepted <br />surety submitted by GALEN E THELMA JEAN HEADLEY and such date shall be considered the <br />date of issuance of the permit and the anniversary date for all other purposes; and <br />!,THEREAS, the Mined Land Reclamation Board has made a finding, far the purposes <br />of issuing this permit, that: <br />1) the application complies with the requirements of the Colorado <br />Mined Land Reclamation act and all applicable local, state and <br />Federal laws; and, <br />2) the operation will not adversely affect the stability of any <br />significant, valuable, and permanent man-made structures located <br />within two hundred feet of the affected land, e:ccept where there <br />is an agreement between the operator a.nd the persons having an <br />interest in the structure that damage to the structure is to be <br />compensated for by the operator; and, <br />3) the proposed mining operations and reclamation can be carried out <br />in conformance with the requirements o° C.R.S. 1973, 34-32-116, as <br />amended (1916 Sess. Laws H.B. 1065); and <br />WHEREAS, for the aurposes of issuing this permit, the operator has made a <br />satisfactory showing to the Board that he will employ during and after his <br />open mining operations procedures reasonably designed to minimize <br />as such as practicable the disruption from the open mining operations <br />and will provide for the rehabilitation of the affected land through the rehahilitation <br />of plant cover, soil stability, water resources, and other measures appropriate to tae <br />subsequent beneficial use of such mined and reclaimed lands; and that in the event <br />of the failure of his proposed zeclamat'_on plan, he will take whatever measures which <br />may be necessary in order to assure the success of reclamation of the lands affected <br />by his open mining operations; and, <br />'.•ir1ERE~5, for the purposes of issuing this permit, a copy of the application <br />approved by the `lined Land Reclamation Board of the Stale of Colorado is attache3 <br />to this permit and thereby becomes a part of the terms hereof. <br />YOW, THEREFORE, pursuant to the authority set forth in the Coloradc `?fined <br />Lard Reclamation act, article 32 of Title 34, C.R.S. 1973, as amended, (1975 <br />Sess. Laws H.B. 1065) the Mined Land Reclamation Board of the State of Colorado <br />hereby issues a life of the mine permit to GALEN b THELMA JEAN HEADLEY to an3a;e <br />in open mining For the purpose of extracting open <br />lined sand L gravel on the following parcel of ground, to wit: <br />NW 1/4 NE 1/4 Section 2g, T. 5N, R. 55W; <br />SW 1/4 NE 1/4 Section 29, T. 5N, R• 55W; <br />NE 1/4 SW 1/4 Section 29, T. 5N, R. 55W; <br />c~.! i/!~ cc 1/4 Section 3e and NW 1/4 NE 114 Section 31, 7.
