LOng <br />Div¢wn Director <br />THIS PERMIT is issued by the Mined Land Reclamation Boazd, Department of Natural Resources, <br />Slate of Colorado. <br />RECITALS <br />A. The Permittee, Wagner Construction, Inc. desires to conduct a mining operation I:novvn as <br />Wagner Rock, for the purpose of extracting sand, gavel, and stone. The Permittee vvRll not mine any secondan <br />commodities at [his site. <br />B. On April 14, 1999 the Mined Land Reclamatic n Board (the "Board") approved the Permittee's <br />application for this permit, fixed the amount of the financial .vrranty and directed that this permit be issued <br />upon the filing with the Division of Minerals and Geology (the "Division") of performance warranty and <br />financial warranty (or warranties) in the amount so fixed in foml and substance approved by the Division. Said <br />warranties have been fixed with the Division. <br />C. If the Permittce desires to extract materials other' than those listed in (A), a separate permit may <br />be required. <br />D. On April 14, 1999 the Board made the following fmdings: <br />I . The application for this pem>it complies with the requirements of the Colorado Mined <br />Land Reclamation Act for the Extraction of Construction Materials, C.R.S. 34-32.5-1O1 et;~q., as amended, <br />and with all applicable local, state and federal laves; <br />2. The operation will not adversely affe,t the stability of am' significant, valuable, and <br />pemuulent man-made structure located within hvo hundred feet of the Affected Land, except where there is an <br />ageement between the Operator and the persons having an inten:st in the structure that damage to the stmcture <br />is to be compensated for by the Permittee; and; <br />
