We are responding to your written request, for a
jurisdictional determination on a portion of Oxbow Mining's
property scheduled for the construction and operation of II West
Coal Refuse Facility_ The property is located along an unnamed
drainage within Sections 7 and 8, Township 13 South, Range 90
west, Delta County, Colorado.
Based on a site inspection by Susan Nall of this office on
July 25, 2003, we determined that the area in question as
outlined on a map titled II West Coal Refuse Facility, General
Facilities and dated May, 2003,. does .not. contain waters of the
• United States. Therefore;."a -epartment of_°tHe--Army permit is not
needed for the placement o~ fill materiai into these areas.
This verification is valid for a period of five years from
the date of this letter unless new information warrants revision
of the determination before the expiration date. A notice of
appeals options is enclosed. You should provide a copy of this
to all other affected parties.
We have assigned number 200375328 to this determination.
