Peabody recognizes <br />the requirements of Rules 4.05.1(4)(b)(iv-v), <br />4.05.3(6)(x), 4.05.4(1)(c), and 4.05.5(2)(e-f) to protect <br />these structures from contributing excessive siltation or <br />erosion. We also understand the need for the utilization <br />of durable riprap in reclamation features requiring riprap <br />in the postmine landscape. <br />It is in Peabody's best interest to utilize the most <br />durable riprap available for operational structures such <br />as ditches and culverts in order to minimize the need for <br />maintenance. However, at this time we do not know what <br />the availability of rock material meeting specific test <br />criteria will be at the II-W mine site. <br />Therefore, in order to meet the requirements of the above <br />cited regulations, we are committing to a semi-annual <br />inspection program for riprap structures along road <br />ditches within the mine site. The integrity of the riprap <br />will be verified immediately after the main snowmelt <br />runoff in the spring and again in the fall (after the <br />summer rains and before snow pack develops). Any <br />necessary remedial action on the riprap structures will be <br />taken no later than June 15 (before summer rains) and <br />again in the fall, before October 15 (before snow pack). <br />Inspection and remedial action records will be kept on <br />file at the mine. <br />Attached are revised pages 12-27 and 12-31 (Volume <br />VII, Tab 12, Appendix 12-3) which incorporates the above <br />
