For this combined plan after <br />the City of Westminster lease there will be a shortage of 6.65 acre-feet for May 2005 and 19.03 acre- <br />feet for October 2005, that will be replaced using excess credits from Aggregate's operations on the <br />Saint Vrain River and South Platte River, as identified above. <br />As mentioned in the previous plan, during the 2004 irrigation season, dewatering at the F-Street <br />Pit ceased. The timing of the lagged depletions from the dewatering operations was determined through <br />a stream depletion model for the F Street Pit. The W.W. Farms Pit has been continuously dewatered <br />since June 2003. The dewatering rate at the W.W. Farms Pit was 400 gallons per minute initially and <br />increased to 750 gallons per minute in Apri! 2004. According to the information provided, mining will <br />begin at the East 8"' Street Pit in June 2005. This site will be continuously dewatered at a rate of 750 <br />gallons per minute. The timing of the lagged deletions from the dewatering operations was determined <br />through a stream depletion model for the East 8 Street Pit. The model addresses the lagged depletions <br />at the F Street, W.W. Farms and Loloff Pits by accounting for the net accretion credits at the river that <br />occur due to the dewatering operation at the East 8"' Street Pit. These accretions are applied to this plan <br />against depletions from the F Street, W. W. Farms and Loloff Pits. <br />In addition 30 Jones Ditch shares used in the previous approval will not be applied to this plan. <br />Only the return flow of the 30 shares is accounted for in the plan. <br />A monthly breakdown of the stream depletions from the mining operations as Weil as the <br />replacements made by lagged timing of the accretion credits is shown in the attached Table 1. <br />As required by Section 8 of Senate Bill 89-120, the East 8"' Street Pit proposal to be added to the <br />combined substitute water supply plan has been provided to an outside consultant for review. Based upon <br />statutory requirements and the recommendations of the consultant for the East 8"' Street Pit, I hereby <br />approve the proposed substitute water supply plan in accordance with Section §37-90-137(11), C.R.S., <br />subject to the following conditions: <br />This plan shall be valid through December 31, 2005 unless otherwise revoked or modified. If this <br />plan will not be made absolute by a water court action by the plan's expiration date, a renewal <br />request must be submitted to this office with the statutory fee (currently $217 per pit) no later <br />than November 15, 2005. <br />2. Anew well permit must be obtained for the current use and exposed pond surface area for the <br />gravel pits whose use has expanded since previously permitted. Those gravel pits are denoted <br />above in Table A. The provisions of Colorado Revised Statute 37-90-137{2) .prohibits the <br />issuance of a permit for a well to be located within 600 feet of any existing well, unless the State <br />Engineer finds that circumstances so warrant after a hearing held in accordance with the <br />procedural rules in 2CCR402-5. This hearing may be waived if you are able to obtain statements <br />from the owners of all wells within 600 feet, verifying that they have no objection to your use of <br />the proposed well. Should a new well permit be denied for reasons of 600 foot spacing, or any <br />other legitimate reason, approval of this substitute supply plan will be canceled. <br />3. The total area of pond surtace exposed after December 31, 1980 for each of the pits shall not <br />exceed those values listed in Table A of this approval. Should the total surtace area exposed <br />exceed those amounts, an amendment will need to be filed with this office. <br />4. The total amount of ground water to be appropriated from each of the pits shall not exceed the <br />values listed in Table B of this approval. <br />
