i~ <br />I Ruling of Referee <br />Oolorado Rivers Edge - 00 CW 244 <br />Page 7 <br />of which 56.50 acre feet of depletions will occur during the Historic Call Period. The <br />net evaporative depletions are summarized on the Water Balance tables attached <br />hereto as Tables A-1 and A-2. <br />(II) Water will be withdrawn from the Custam Crushing Pits as product <br />moisture and for aggregate washing purposes during mining operations. The product <br />mined from the Custom Crushing Pits will include product moisture in the amount <br />of four percent (4%) of the material mined during the yeas, and water will be pumped <br />from the Custom Crushing Pits (or a settling pond located adjacent thereto) at the <br />maximum rate of 1,500 g.p.m. for aggregate washing purposes. Of the total amount <br />of water withdrawn and diverted as product moisture and for aggregate washing <br />purposes, 2.96 acre feet per year will be depletions Ito the river system. The <br />remainder of the amount diverted for aggregate washing 'll be discharged back into <br />the Custom Crushing Pits or into the Colorado River adjacent to the Pits. The <br />diversions and depletions for product moisture losses and aggregate washing could <br />occur at various times during the yeaz, both during and outside of the Historic Call <br />Period. <br />(III) Water will be pumped from the Custom Crushing Pits at the <br />maximum rate of 150 g.g,m. for dust suppression purposes in connection with gravel <br />crushing activities. Applicant anticipates that a total of X0.66 acre feet of water per <br />yeaz will be diverted for dust suppression purposes, and that such amount will be <br />totally consumed. <br />(I~ During mining, the Custom Crushing Pits will be dewatered at a <br />maximum rate of 5,000 g.p.m., with the water being discharged to the Colorado <br />River. However, these dewatering operations will not i sult in any depletions in <br />addition to those described above. <br />(V) Evaporation losses from the Custom Cnishing Pits will occur both <br />during mining operations and after mining operations laze completed. All other <br />diversions and depletions will occur only while mining operations at the Custom <br />Crushing Pits aze ongoing. Once mining operations have been completed at the <br />Custom Crushing Pits, these other diversions and depletions will cease. Total <br />depletions during the Historic Call Period will not exceed 160.12 acre feet, as set forth <br />on the Water Balance table attached hereto at Table A-1 ~ <br />D. Applicant is entitled to certain depletion credits (collectively referred to herein <br />as the "Depletion Credits") in connection with the development of the Custom Crushing Pits <br />and with respect to the water rights described in Paragraph 14, ab~, ove, described as follows: <br />
