APPLICATION FOR PERMIT UNDER THE COLORADO STATE COAL MINING RECLAMATION ACT Introduction Energy Fuels Corporation hereby applies to the Colorado Mined Land Reclamation Board for a permit to conduct surface coal mining and reclamation operations. This application is submitted pursuant co the requirements of the Colorado Surface Coal Mining Reclamation Act of 1979, C.R.S. 1973, S 3433101 et ~. ("the Act"). Application is made for a permit in accordance with the. act rather than the Colorado Pfined Land Reclamation Act of 1976, C.R.S. 1973, S 3432101 et sec., due to the fact that the definitions of "mineral" and "mining operations" in the Colorado Mined Land Reclamation Act have been amended (effective Suly 1, 1979) to exclude coal and the development or extraction of coal, respectively. By this change, coal mining would appear to be affectively removed from the jurisdictional scope of the Colorado PSined Land Reclamation Act and subject instead to regulation under the Act. All of the information required for a permit under the Act is contained in the accompanying Permit application. Rather than repeat and thus greatly prolong this application, Energy Fuels Corporation has, instead, cross-referenced those provisions of the Act defining the required infor- :r.:tion for a permit application to those parts or sections of this application to those parts or sections of this application containing the revelant information. By these cross-references Energy Fuels Corpora- tion incorporates by reference here the information contained in *_he cross- referenced section.
