PART 822 - SPECIAL PERMANENT PROGRAM PERFORMANCE STANDARDS-OPERATIONS
IN ALLUVIAL VALLEY FLOORS
Scone of the Section.
Part 822 establishes the performance standards for surface coal
mines in or adjacent to alluvial valley floors. The identification
of alluvial valley floors and their essential hydrologic functions
is covered in 30 CFR 785.19. Those surface coal mine operations
which are determined by the criteria of 30 CFR 785.19 to affect
alluvial valley floors must comply with the performance standards
of this Part. Operations which are found by a field investigation
not to affect alluvial valley floors are exempt from the require-
ments of this Part.
The field investigation described in Section 765.19 (c) resulted in
no identification of alluvial valley floors in the general area
which could be affected by mining operations. Therefore, no
• special performance standards for operations in alluvial valley
t
- floors are applicable to this mining permit application, and no
protective or remedial measures are proposed for compliance with
this Part.

822-1
