East a distance of 1,051 feet, which headgates are the initial <br />point of survey for Eckman Park Reservoir No. 2. <br />(c) Ec}~an Park Ditch Nos. 4 and 5: The headgate <br />is a combination headgate located at a point whence the S~ corner <br />of Section 7, Township 4 North, Range 86 West, bears South 2°50' <br />West, 981 feet. <br />(d) Supplemental or alternate points of diversion <br />for the Eckman Park Ditch Nos. 1, 2, 3, 4 and 5 are as follows: <br />The NW corner of the NEi NE$, Section 13, <br />Township 5 North, Range 86 west; <br />The SW corner of the NE ;, Section 31, <br />Township 5 North, Range 86 West: <br />A point 500 feet South of the North line and <br />1200 Peet East of the west line of Section <br />32, Township 5 North, Range 86 West. <br />Source: Foidel Creek <br />Appropriation date: February 28, 1979. <br />Amount: 13 1/3 c.f.s. Historical consumptive use <br />has previously been quantified at 80.33 acre feet per year for <br />Eckman Park Ditch Nos. 1, 2, 3, 4, and 5, collectively in Case <br />Nos. W-1186-7; and 79CW132, Water Division No. 6, for the years <br />1905-1981. Historic consumptive use for 577/937 of the water <br />right is 49.47 acre feet per year. For the remaining 360/937 of <br />the water right, which is effectively being changed to the uses <br />set forth below, historic consumptive use is 27.27 acre feet per <br />year. Thus, the total historic consumptive use from Eckman Park <br />Ditch Nos. 1-5 is 76.74 acre feet per year. <br />' Use: 360/937 of the total 13 1/3 c.f.s. decreed <br />to Eckman Park Ditch Nos. 1-5 was previously decreed for <br />irrigation. A change in use for the remaining 577/937 of the <br />13 1/3 c.f.s. water right from irrigation to commercial, <br />industrial and mining, including but not limited to dust control <br />and related purposes, was authorized by decree in Case No. <br />W-1186-77. As set forth in paragraph 8 below, the inclusion of <br />Eckman Park Ditch Nos. 1-5 in the augmentation plan will have the <br />effect of changing the use of the entirety of those water rights <br />to storage for later year-round use in mining, reclamation, <br />irrigation, electrical generation, fish propagation, and other <br />beneficial uses. <br />-6- <br />
