ti <br />Filing of Application and Jurisdiction: <br />t <br />The application for amendment in Case No. 90CW99 (W- <br />1502-78) was filed in Water Division No. 6 on August 8, 1990. <br />Notice of the application was duly published pursuant to Colo. <br />Rev. Stat. § 37-92-302 (1973 and Supp. 1988). The Court has <br />jurisdiction over the subject matter of this application and over <br />all those persons and entities who have standing to appear as <br />parties, whether they have appeared or not. None of the water <br />rights or sources of the water rights involved in the application <br />are located within a designated ground water basin. <br />3. Statements of Opposition: <br />Statements of opposition to the application were timely <br />filed by the Colorado-Ute Electric Association, Inc.; the Twenty <br />Mite Water Company and Emilyn Young; and Jeris A. Danielson, <br />State Engineer, and Edward Blank, Division Engineer. l+:: other <br />statements of opposition or motions to intervene were filed, and <br />the time for filing statements of opposition has expired. <br />4. Original Findings of Fact. Conclusions of Law <br />and Decree for the Plan of Augmentation: <br />The original Findings of Fact, Conclusions of Law and <br />Decree for the plan for augmentation entered by this Court on <br />July 10, 1981 in Case No. W-1502-78 (hereinafter referred to as <br />the "Original Decree") is incorporated herein by reference, <br />except to the extent modified herein. <br />Additional Structures to be Augmented: <br />The following water rights and sources of water owned <br />by the applicant will be added to the list of structures to be <br />augmented which are described as "Underground Rights" on page 4 <br />of Exhibit A to the Original Decree. The water rights described <br />in paragraphs 5.a, 5.b, and 5.c below and those water rights <br />described as "Underground Rights" on page 4 of Exhibit A to the <br />Original Decree will hereinafter collectively be referred to as <br />"Underground Rights." <br />a. New EneraY Well No. 6 <br />Well Permit: Permit No. 035463-F <br />Previous Decree Entered: Case No. BSCW18, Water <br />Division No. 6, June 23, 1989. <br />Location of Well: SW$ NWT, Section 32, Township <br />5 North, Range 86 West of the 6th P.M., Routt County, Colorado at <br />a point located approximately 3200 feet from the South section <br />line, and 55 feet from the West section line of said Section 32. <br />-2- <br />
