Source: Foidel Creek <br />Appropriation date: April 30, 1980. <br />Amount: 11.2 acre feet. <br />Use: Irrigation, reclamation, recreation, fish <br />propagation, aesthetic, domestic (including provision of domestic <br />water supply to residences and employee quarters in connection <br />with mining operations), industrial, commercial, mining and <br />mineral processing, suppression of fugitive dust, electrical <br />generation (in connection with mining operations or facilities <br />located on mine property), fire prevention, stock watering, and <br />all other beneficial uses including exchange, substitution, <br />replacement, and augmentation. <br />8. Historical Use. <br />Eckman Park Ditch Nos. 1-5: These water rights were <br />originally decreed for irrigation purposes. Until the 1970's, <br />the water rights were used for irrigation purposes. The <br />historical consumptive use has been quantified at 80.33 acre feet <br />for the five ditches collectively in Case Nos. W-1186-77 and <br />79CW132, Water Division No. 6 for the years 1905-1981. <br />Additionally, Case No. W-1186-77 converted 577/937th of this <br />water right to year-round use, resulting in 49.47 acre feet per <br />year from the Eckman Park Ditch Nos. 1-5 being available for <br />mining purposes. The remaining portion of the Eckman Park Ditch <br />water rights (360/937th) currently remains decreed for irrigation <br />purposes only. The inclusion of the Eckman Park Ditch Nos. 1-5 <br />in the augmentation plan will have the effect of changing the use <br />of the entirety of those water rights to storage for later year- <br />round use in mining, reclamation, irrigation, electrical <br />generation, fish propagation and all other beneficial uses, as <br />set forth in paragraph 6 above. Historic consumptive use for the <br />360/937 portion of the Eckman Park Ditch water right is 27.27 <br />acre feet per year. Therefore, the total historic consumptive <br />use from the Eckman Park Ditch Nos. 1-5 that will be available in <br />this augmentation plan is 76.74 acre feet per year. <br />Statement of Amendment to Plan for Augmentation <br />Including Exchanges: <br />a. Description of Water Uses: Applicant is a <br />Colorado corporation, primarily engaged in mining low-sulfur coal <br />in Routt County, Colorado. Applicant also engages in stock <br />watering and irrigation in connection with its ranching <br />operations. The particular mine involved in the present <br />Application for Approval of Amendment to Plan for Augmentation is <br />known as the Yampa Mine and is located in Townships 3, 4, 5, and <br />6 North, Ranges 85, 86, and 87 West, 6th P.M. The Yampa Mine is <br />in the watersheds of Foidel, Trout, Middle, and Fish Creeks, <br />-12- <br />
