Long <br />Division Dneaar <br />The Division of Ivtinerals and Geology has completed review of the 3rd quarter surface water <br />report for 1998 for the Raton Creek mine. #C-82-055. All portions of the report were reviewed, <br />including flow data from the sediment pond and permanent diversion, sediment pond inspection, <br />water sampling data, coal processing waste bank inspection, and weather station data. <br />The report demonstrates compliance with Rule 4.05.6(13) for sediment ponds and Rule 4.10.2(2) <br />for coal mine waste banks. In particular, the engineer is noting the presence or absence of <br />seepage that could affect the pile stability, in accordance with Rule 4.10.2(2). <br />Please forward the reports for the 4d' quarter of 1998 and the first quarter of 1999 for review by <br />the Division. We have no further questions or comments at this time.
