(ii) <br />include a statement of intended operations for <br />the next succeeding quarter. <br />Copies of drill and core logs, geologic data,' <br />sports of sampling and testing of coal and coal <br />deposiu, identification of drill hole locations, and <br />other factual data (aclusive of interpretation) <br />obtained by Lessee which pertain to the Leased <br />Premises. <br /> 9. Assignment. Assignment by Lessee of this Lease shall be subject to <br /> approval by Lessors based upon the financial, technical and operati..rtal capabilities of the <br /> assignee to perform and comply with the terms hereof, but which approval shall not be <br /> unreasonably withheld. Notwithstanding the restriction on assignment as forth herein, the <br /> rights of the Lessee shall be freely assignable, without consrnt of Lessors to working <br /> interest owners, provided, however, that such azsignments would 6e effective only upon <br /> receipt of written notice of assignment by Lessors. <br />` 10. Taxes. Lessee shall pay all nd valorem or other property taxes levied and <br /> assessed against the Leazed Premises. Lessee shall also pay all production, excise, <br /> severance and other taxes that now or hereafter may be levied and computed on the <br /> amount or value of coal which is mined and sold or otherwise disposed of from the <br />I <br />Leased Premises. <br /> 11. Liens. Lessor shall not cause or permit a lien or encumbrance w attach or <br /> remain thereon on account of any debt for materials or services furnished to Lessee for <br /> operations pursuant to this Lease; provided, however, that Lessee shall not be required <br /> to remove any such lien for materials or services so long as it is contesting, in good faith, <br /> the validity or the amount thereof. <br /> 12. Indemnifiartlon. Lessee agrtxs to indemnify and save Lessors harmless <br /> from and against any and all losses, claims, damages, and liabilities arising or charged to <br /> arise az a result of operations by Lessee upon the Leased Prcmisca or otherwise pursuant <br /> to this Lease, including without limitation, injuries to persons, damage to property, liens <br />1 claimed or arising out n( work performed or things furnished, or failure to comply, or <br />• <br />i <br />i claims of failure to comply, with applicable governmental laws, regulations, licenses and <br />~ <br />1 S <br />
