..'iuL•.~.• <br /> <br />~lf~~~~~ <br />include a statement of intended operations ~ for <br />the next succeeding quarter. <br />(ii) Copies of drill and core logs, geologic data, <br />reports of sampling and testing of coal and coal <br />deposits, identification of drill hole locations, and <br />other factual data (exclusive of interpretation) <br />obtained by Lesser which pertain to the Erased <br />Premises. <br />9. Assignment. Assignment by Lesser of this Lease shall be subject to <br />approval by Ixssors haled upon the financial, technical and operational capabilities of the <br />assigner to xrfornt and comply with the terms hereof, but which approval shall not be <br />unreasonably withheld. Notwithstanding the restriction on assignment as forth herein, !!'e <br />rights of the Lessee shall be freely assignable, without consent of Lessors to wort.ing <br />interest owners, provided, however, that such assignments would be effective only tt~nn <br />receipt of k ritten notice of assignment by Lessors. <br />10. Taxes. Lesser shalt pay all nd valorem or other property taxes levied :+~td <br />assessed against the Leased Premises. Lessee shall also pay all production, excise, <br />severance and other taxes that now or hereafter may be levied and computed on t`te <br />amount or valuE of coal which is mined and sold or otherwise disposed of from the <br />Leased Premises. <br />11. Liens. Lesser shall not cause or permit a lirn or encumbrance to attach or <br />remain thereon on account of any debt for materials or services fumished to Ixsser for <br />operations pursuant to this Lease; provided, how^ver, that Lessee shall not be required <br />to remove any such lien for materials or services s~ long as it is contesting, in good fault, <br />the validity or the amount thereof. <br />12. Indemnification. Lessee agrees to indemnify and save Lessors harmlc~~s <br />from and against any and all losses, claims, damages, and liabilities arising or charged r~ <br />arise as a result of operations by Lessee upon the Ceased Premises or otherwise pursuant <br />to this Lease, including without limitation, injuries to persons, damage to property, lic~~.s <br />claimed or arising out of work performed or things furnished, or (allure to comply, or <br />claims of failure to comply, with applicable governmental laws, regulations, licenses and <br />5 <br />
