It is my understanding that this seep is outside the mining boundary and below pond 005, however it is above the dam for outfall 005. For this reason, it has been routed so that it discharges through outfall 005 and would mix with any flow from the pond going to Coyote Gulch. Mr. Henderson indicated that the seep is monitored, but that this analytical data are not included on the discharge monitoring reports (DMR) for outfall 005. 1 spoke to Joe Dudash with the Colorado Division of Minerals and Geology (CDMG) last week to see what itlfonnation fife CDMG had on this seep. They have very little information on file concerning it and neither Joe nor the previous specialist, Kent Gorham, was aware of why this seep would he included in the permit. He rioted that his file showed that Trapper only monitored the seep if the Flow appeared to be above 5 gallons per minute. As long as it is covered under the CDPS permit, a~ flow should be monitored and the results reported on the DMR. 1 left a request on Larry's voice mail last week to submit analytical data for the seep to my office for review. l do no[ know for certain if he received the request because L did not ask for a confirmation call back. This letter is a supplemental written request for these same data. Please submit at least the previous five years data for all parameters monitored for this seep. The permit amendment currently being drafted will leave outfall 005 as it is currently covered. It is possible that if [he data indicate that [he seep does not appear to be influenced by pas[ or present mining activity, [he seep Flow may be excluded from the permit. if we reach this conclusion, the permit will be reopened at a later date for appropriate changes. }lowever, at the present, since it discharges through an outfall covered under the permit, data from the seep should he included on DMRs for outfall 005, regardless of the flow volume.
