A lagoon system will be used. There being no objections from <br />anyone in the audience, the Planning Staff's recommendation was not read <br />into the record. <br />MOTION: Be it therefore resolved to recommend approval based on the <br />Planning Staff's recommendation with the Development Standards to the <br />Board of County Commissioners. Motion by Fred Otis, seconded by Jerry <br />Kiefer. W?~ NW 4, Section 19, T6N, R67W <br />LOCATION: 1~ miles west of Windsor, 1/8 mile south of Colorado Highway 392 <br />APPEARANCE: Jerry McRae <br />DISCUSSION: This request is to excavate the gravel lying on a 9.9 acre <br />tract. The majority of the gravel extracted will be used as pit-run <br />material and excavated and loaded as required. Buildings and stockpiles <br />will be located toward the west end of the site near the access road. <br />The excavation will begin at the east end of the site and work toward the <br />west end of the site. Access will be to County Road 13. There being no <br />questions at this time Tom Honn read the Planning Staff's recommendation <br />for approval and the Operations Standards into the record. Darrell Todd <br />of the Division of Wildlife then stated the department's opposition to <br />this proposal because there is a permanent easement on this site. Mining <br />or any other activity that disturbs vegetation and/or changes the current <br />use of the land covered by the permanent easement is a violation of that <br />easement. Bob Bosley, attorney for the Frank's, stated that they will be <br />working with the Division of Wildlife and cooperate with them to resolve <br />the situation.
