:.._ ,~ _ u <br />:, , „ .,., <br />.~ ~=~- _ <br />N. =?~ ~ - ~ UNDERSTANDING <br />I Both parties have specific and separate statutory reaponeibillties to review permit <br />applications, monitor and inspect field sites, and take enforcement action. The <br />parties exercise of their respective reaponeibilitLee has the potential for <br />duplication and inconsistent actions by the parties in the management of hydrologic <br />balance and water quality issues with respect to the responsibilities. This MOII <br />addressee each area of responsibility separately. <br />Review of Permit Applications <br />The parties will coordinate the review of hydrologic information submitted within <br />a coal mining permit application with respect to information relevant to Colorado <br />Discharge Permit.Syetem (CDPS) permits for process/mine water and atormwater pint <br />w en a e o ow ng: <br />1. During pre-application meetings with potential coal mine permit applicants, <br />each party will advise the applicant of the need to contact the other party. <br />2. DMG will review the coal permit applications to determine whether the <br />sediment control structures will be designed to meet technology based <br />effluent limitations and that any atormwater control technologies are in <br />conformance with the Rules and Regulations for Coal Mining, CRS 34-33-101. <br />3. The parties will confer, ae appropriate, during the course of permit review <br />and drafting to coordinate where there may be duplication or potential <br />conflict, and to keep each party apprised of technical developments. <br />4. WQCD will provide DHG with copies of all final CDPS permits actions for coal <br />mines, at the time of action issuance. Conversely, DMG will provide WQCD <br />copies of all notices of final action on coal mining permits. <br />Training <br />WQCD will provide water quality sample collection training to DMG staff upon the <br />request of DMG. Each party will also provide general inspection training upon the <br />request of the other party. <br />Inactions, Monitoring and Sample Analveie <br />The parties will coordinate inspections, monitoring and sample analysis in the <br />following manner: <br />i. In those instances where effluent violations are suspected, DMG shall collect <br />water quality samples at CDPS discharge points during the course of <br />conducting its normal site inspection obligations. In those instances where <br />DMG suspects an unpermitted discharge, DMG shall collect a water quality <br />sample for analysis. <br />2. DMG shall include in its inspection reports which accompany a sample result <br />specified in item 1 of this section a detailed description of site conditions <br />and a discussion as to whether a precipitation event has occurred at the site <br />within the preceding 24 hours. <br />3. To the extent funds allow, WQCD shall pay for the cost of analysis for <br />samples collected pursuant to item 1 of this section. Such samples are to be <br />delivered to the Laboratory Division of the Colorado Department of Health for <br />analysis. DMG shall absorb the cost of obtaining the samples and <br />transmitting them to the lab. <br />4. Sample collection by DMG shall Follow all chain-of-custody and other normal <br />enforcement procedures to ensure sample integrity. <br />2 <br />
