"~" <br />March 31, 1995 <br />• III ~II~I~~II~~II~II <br />Montrose County Commissioners <br />Box 1289 <br />Monu-ose, CO 81402 <br />Dear Commissioners: <br />~ECEIVFr, <br />(APR 10 1995 <br />Division or rvune~a~a a aeoiu9Y <br />~V <br />f-t-44-cR7 <br />We are writing regarding the proposed Spring Creek Gravel Pit proposed by <br />Million Agricultural Investments Limited.. <br />The original application for this pit was received by the Colorado Division of <br />Minerals and Geology (DMG) on September 16, 1994. However, the DMG did <br />not recognize the application as complete until December 9, 1994. Since that <br />date, a technical review has been conducted by the DMG and additional requests <br />for information have been sent to Million Agricultural Investments Ltd. It is <br />anticipated that the Spring Creek Gravel Pit will receive the DMG's approval on <br />April 27, 1995. <br />CRS 34-32-112 (the statute governing notification for the 112 permit for which <br />Million applied) states that, "Upon the filing of an application for a reclamation <br />permit with [DMG], the applicant shall place a copy of such application for public <br />inspection...at the office of the county clerk and recorder. The copy... shall not be <br />recorded but shall be retained there until said application has been heard by the <br />[DMG] and be available for inspection during such period..." Additionally, "the <br />applicant shall cause notice of the filing of such applicant's application to be <br />published in a newspaper of general circulation in the locality of the proposed <br />mining operation once a week for four consecutive weeks, commencing not more <br />than ten days aher the filing of said application with the [DMG]." <br />The fast notification regarding the Spring Creek Gravel Pit received by the <br />County Clerk occurred on November 10, 1994 when Million Agricultural <br />Investments Ltd. submitted an Amended Application fora 112 Reclamation <br />Permit. A "public notice" regarding the pit was filed with the County Clerk on <br />December 12, 1994 and another Amended 112 Permit Application was filed with <br />the County Clerk on December 22, 1994. Notification in "a newspaper of general <br />circulation" appeared in the Montrose Daily Press on December 23 and 30, 1994 <br />and January 6 and 13, 1995. <br />
