The original application for this pit was received by the Colorado Division of Minerals and Geology (DMG) on September 16, 1994. However, the DMG did not recognize the application as complete until December 9, 1994. Since that date, a technical review has been conducted by the DMG and additional requests for information have been sent to Million Agricultural Investments Ltd. It is anticipated that the Spring Creek Gravel Pit will receive the DMG's approval on April 27, 1995. CRS 34-32-112 (the statute governing notification for the 112 permit for which Million applied) states that, "Upon the filing of an application for a reclamation permit with [DMG], the applicant shall place a copy of such application for public inspection...at the office of the county clerk and recorder. The copy... shall not be recorded but shall be retained there until said application has been heard by the [DMG] and be available for inspection during such period..." Additionally, "the applicant shall cause notice of the filing of such applicant's application to be published in a newspaper of general circulation in the locality of the proposed mining operation once a week for four consecutive weeks, commencing not more than ten days aher the filing of said application with the [DMG]." The fast notification regarding the Spring Creek Gravel Pit received by the County Clerk occurred on November 10, 1994 when Million Agricultural Investments Ltd. submitted an Amended Application fora 112 Reclamation Permit. A "public notice" regarding the pit was filed with the County Clerk on December 12, 1994 and another Amended 112 Permit Application was filed with the County Clerk on December 22, 1994. Notification in "a newspaper of general circulation" appeared in the Montrose Daily Press on December 23 and 30, 1994 and January 6 and 13, 1995.
