CONCLUSION
As set forth above, there are compelling reasons for the Board to preclude, in whole or in
part, the objections set forth in the draft Order. By deciding to heaz certain of the objections, the
Board will have provided the objectors a third chance at identifying issues that should have been
identified long ago in this process. That stated, should the Board choose to hear the issues, either
in whole or in part, there are no substantive grounds presented upon which the Board could deny
the application. Therefore, by law, and it's own procedural rules, the Board is required to issue
the permit.
Respectfully submitted this 16th day of June, 2000.
MASSEY SEMENOFF STERN & SCHWARZ, P.C.
~~ ~~
Jeffr~~Schwari, Esq.
730 Seventeenth Street, Suite 330
Denver, Colorado 80202
(303) 893-1815
ATTORNEYS FOR APPLICANT
MOBILE PREMIX CONCRETE, INC., A
SUBSIDIARY OF LAFARGE CORPORATION
