(b) the death or injury to ATLANTIC F.ICHFIELD's
employees and for damage to ATLANTIC RICHFIELD'S
property caused by OPERATOR or its officers,
employees, agents, or representatives;
(c} OPERA`fOR's noncompliance with the terms and
conditions of Section 8 hereof; or
(d) the injury to or death of third parties or
damages to their property;
unless the incident or occurrence described in (a), (b), (c), or
(d) results from the sole negligence of ATLANTIC RICHFIELD.
12. INSURANCE
From the time of commencement of the Work hereunder until
completion of the Work and removal of all remaining materials,
implements, equipment, fixtures, and supplies and personnel from the
• Coal Leases, OPERATOR shall provide and maintain in effect the
following types and amounts of insurance with insurance companies
satisfactory to ATLANTIC RICHFIELD:
(a) Ylorkmen's Compensation and Employer's Liability Insurance,
including Occupational Disease in accordance with the laws
of the State of Colorado where the Work is to be performed
and Employer's Liability Insurance in the limit of not less
than $1,000,000 per person per accident. OPERATOR shall
also provide and maintain insurance covering the payment of
Black Lung benefits as required pursuant to Title IV of the
Federal Coal Mine Health and Safety Act of 1969 as Amended,
and regulations pursuant thereto.
(b) Comprehensive General Liability Insurance, including
contractual liability insuring the indemnity agreement set
forth in this Contract with limits of not less than
5250,000 applicable to bodily injury, sickness or death in
any one occurrence; and 5500,000 for loss of or damage to
property in any once occurrence.
(c) Automobile Liability Insurance covering owned, non-owned
