S.l Owner grants GALLEGOS all property rights necessary for GALLEGOS to conduct its Operations oa the Property pursuant to the Mining Plan and Permits, including mining and removal of the Minerals. These tights shall include the right of ingress to and egress from the Proyertp and the benefit of use of existing easements appurtenant to the Property. 5.2 The rights to the Property ancillary to the sale and purchase of the Minerals herein psovided shall constitute a lease. Such property rights granted to GALLEGOS shell not affect the right of the Owner to ingress and access to sad from the property. GALLEGOS shall have the right to allow other persona or entities reasonable ingress and egress to sad from the Property for the purpose of aseietiag GALI.EGOS in its Operations. Those rights granted hereunder which are ancillary to GAL7.EGOS' Operations, possession of the Property and the purchase of Minerals provided herein shall not extend to the use of the property fnr residential or aqy other non-commercial use. 5.3 During the term of this Aa~reement. GALLEGOS shall have the exclusive right and authority to enter and cake possession of the Property and mine, remove and produce such amounts of Minerals as GALLEG05 desires to mine and remove from the Property. Owner also groats to GALLEGOS the right to use, disturb and destroy so much of the surface as may be reasonably necessary for (a) the use nod maintenance of roads, end .(b) the use. operation, storage sad maintenance of Minerals, equipment and facilities used in connection with its Operations on the Property, pursuant to sad is compliance. with the Mining plan and Permits.
