Long <br /> Duis~on Dnector <br />Re: Evans Pit #2 Permit Application, File No. M-2000-041 <br />Dear Mr. Gagliano: <br />The Division received and reviewed your response to the May 17, 2000 adequacy letter. <br />Following is one clarification and one reminder: <br />1) You state that the permit area will be mined in 5 acre cells and that it will take 3 years to <br />effectively secure the water augmentation plan so that 15 acres will be mined before the <br />water rights issues are resolved. ]t is understood from your statement that until the water <br />r~ ~ rights issues are resolved no more than 15 acres will be mined. However, after the water <br />/ rights issues are resolved, the operator will mine the affected lands in 50 acre parcels <br />U (pursuant to the proposed mining plan). Also, the operator will provide sufficient funds in <br />~i the bond to backfill and reclaim the l5 acre pit and the borrow area (reseed etc.). The <br />J I bond will be reduced after the water rights issues are resolved; upon receipt of a request <br />for a reduction from the operator. If this is an accurate statement, please acknowledge. <br />S ~~ 2) A copy of the access lease from Mineral Reserves, Inc. to Western Mobile Southern, Inc. <br />is the only document that still needs to be submitted. Please submit before June 14, 2000. <br />~~~°~`" <br />The $838,618 financial warranty estimate you provided is acceptable for backfilling operations <br />of the 15 acre pit and the borrow area.
