The Defendants answered Plaintiffs'complaint by filing a general denial. On April 13, 1989, the Court granted Summary Judgment in favor of Plaintiffs to the mineral rights which were the subject of Plaintiffs'Second Claim for Relief. i That Order was amended and as amended reaffirmed on April 19, I I 1989. Although Motions for Summary Judgment were filed by Plaintiffs with .regard .to .the other two claims for Relief these i Summary Judgment claims were denied and these matters were the ~. subject of the Trial of July 18 and 19. 6. The real property which is the subject matter of ~ this action is situated in the County of Prowers in the State ~ of Colorado and is described more particularly in Exhibit "A" which is attached hereto and made a part hereof by reference. 7. The Defendants, Gene Hammit and Darla Hammit, executed and delivered to the Federal Land Bank of Wichita, If hereinafter called FLBW, a Deed of Trust in the original principal sum of $2,550,000.00 dated and recorded December 4, :'r.. 1978, in the records of Prowers County, Colorado, at Reception No. 397336, a copy of which was admitted as Plaintiffs' Exhibit ._i "A",. The Hammits also gave the FLBW a Security Agreement and'. Financing Statement of even date describing improvements constructed on Hammits'land and on the right-of-way of the i AT6SF, which right-of-way is located for purposes of this ~ action in the N§ of Section 13, T 23 S, R 42 W, which Financing Statement was duly continued on March 12, 1989, i as shown by Plaintiffs' Exhibit "C".
