The losses associated with this mining operation must not exceed a total of 62.03 <br />acre-feet for the duration of this permit approvaL_ These losses include 12.10 <br />acre-feet of evaporation from the proposed exposure of 4.2 acres of groundwater, <br />3.31 acre-feet of water used. for dust suppression, 24.55 acre-feet of water used in <br />concrete hatching due to 160,000 cubic yards of concrete production and 22.06 <br />acre-feet of water lost in 750,000 tons of mined aggregate.. Should the lagged <br />annual. depletions to the South Platte River exceed 62.03 acre-feet from this pit <br />prior to the expiration date of this plan,. an amendment will need to be filed with <br />this office.. <br />5. The applicant must provide adequate information to the water commissioner to <br />show that the depletions that occurred in October 2003 were adequately replaced. <br />6. Approval of this plan is for the purposes as stated herein. Any additional uses of <br />this. water must firsl be approved. by this office.. Any future additional historic <br />consumptive use credit given (e.g., agricultural water transfer) for this site must <br />consider alt previous credits given. <br />7. All pumping for dust control shall be measured in a manner acceptable. to the. <br />Division Engineer.. <br />8. Dewatering at this site will produce delayed depletions to the stream system.. As <br />long as the. pit is continuously dewatered,. the water returned to the stream system <br />should. be adequate to offset the. depletions... However,' once dewatering. at the site <br />ceases the delayed depletions must be addressed.. At least three. years prior to <br />completion of dewatering,. a plan. must be submitted that specifies how the post <br />pumping dewatering. depletions will be replaced, in time, place and amount.. <br />9. The water commissioner responsible for the administration of this plan. is Mr. <br />Robert Stah1,.9378 WCR 25, Fort Lupton,. CO 80621, phone no.. (303j 857-0742. . <br />Adequate records of diversion, replacement and. amounts of. water used. for <br />particular. uses must be provided to the division engineer and the water <br />commissioner on a monthly basis. or other interval acceptable to both. of them on a <br />form approved by them. <br />10.. Tfie name,. mailing address,. and phone number of the contact person. who will. be <br />responsible for operation and. accounting of this plan must be provided. on the <br />accounting forms to the division. engineer and. water commissioner. <br />11. The approval of this substitute water supply plan does not relieve. the. Applicant <br />and/or landowner of the requirement to obtain a Water Court decree approving. a. <br />permanent plan for augmentation or mitigation to ensure the. permanent <br />replacement of all depletions,. including long-term evaporation losses. after. gravel. <br />mining operations have ceased. If reclamation of the mine site. will produce a <br />permanent water surface exposing groundwater to evaporation,. an application for <br />a plan for augmentation must be filed. with the Division 1 Water Court at least <br />three (3) years prior to. the completion of mining. to include, but not be limited to,. <br />long-term evaporation losses.. If a lined pond results after reclamation,. <br />replacement of lagged depletions shall continue until there is no longer an effect <br />on stream Flow.. <br />
