4. The losses associated with this mining operation must not exceed a total of 62.03
acre-feet for the duration of this permit approvaL_ These losses include 12.10
acre-feet of evaporation from the proposed exposure of 4.2 acres of groundwater,
3.31 acre-feet of water used. for dust suppression, 24.55 acre-feet of water used in
concrete hatching due to 160,000 cubic yards of concrete production and 22.06
acre-feet of water lost in 750,000 tons of mined aggregate.. Should the lagged
annual. depletions to the South Platte River exceed 62.03 acre-feet from this pit
prior to the expiration date of this plan,. an amendment will need to be filed with
this office..
5. The applicant must provide adequate information to the water commissioner to
show that the depletions that occurred in October 2003 were adequately replaced.
6. Approval of this plan is for the purposes as stated herein. Any additional uses of
this. water must firsl be approved. by this office.. Any future additional historic
consumptive use credit given (e.g., agricultural water transfer) for this site must
consider alt previous credits given.
7. All pumping for dust control shall be measured in a manner acceptable. to the.
Division Engineer..
8. Dewatering at this site will produce delayed depletions to the stream system.. As
long as the. pit is continuously dewatered,. the water returned to the stream system
should. be adequate to offset the. depletions... However,' once dewatering. at the site
ceases the delayed depletions must be addressed.. At least three. years prior to
completion of dewatering,. a plan. must be submitted that specifies how the post
pumping dewatering. depletions will be replaced, in time, place and amount..

Adequate records of diversion, replacement and. amounts of. water used. for
particular. uses must be provided to the division engineer and the water
commissioner on a monthly basis. or other interval acceptable to both. of them on a
form approved by them.

responsible for operation and. accounting of this plan must be provided. on the
accounting forms to the division. engineer and. water commissioner.
11. The approval of this substitute water supply plan does not relieve. the. Applicant
and/or landowner of the requirement to obtain a Water Court decree approving. a.
permanent plan for augmentation or mitigation to ensure the. permanent
replacement of all depletions,. including long-term evaporation losses. after. gravel.
mining operations have ceased. If reclamation of the mine site. will produce a
permanent water surface exposing groundwater to evaporation,. an application for
a plan for augmentation must be filed. with the Division 1 Water Court at least
three (3) years prior to. the completion of mining. to include, but not be limited to,.
long-term evaporation losses.. If a lined pond results after reclamation,.
replacement of lagged depletions shall continue until there is no longer an effect
on stream Flow..
