Simpson, P.E. <br />State Engineer <br />This letter is in response to your application of November 6, 2002 requesting a substitute <br />water supply plan for a gravel pit to be operated. by the Hall-Irwin Corporation, Inc., in accordance <br />with §37-90-137(11) C.R.S. The Applicants shall be responsible for compliance with this plan, but <br />the State Engineer's Office may also pursue the landowner, for eventual compliance. The <br />required. fee of $1,343 for the substitute water supply plan has been paid. <br />The anticipated net depletion for this plan is 62.03 acre-feet per year for up to 4.2 acres of <br />water surface exposed. after December 31,.1980. According to the information submitted, no <br />water surface was exposed within the reclamation permit boundary prior to January 1, 1981. <br />You have provided a monthly. breakdown. of the. maximum annual depletions totaling <br />12.1 acre-feet of evaporative loss from a maximum of 4.2 acres of exposed groundwater, 3.31 <br />acre-feet of water used and consumed for dust control,. 24.55 acre-feet of water used in <br />concrete batching due to 160,000 cubic yards of concrete production, and. 22.06 acre-feet of <br />water lost with the 750,000. tons. of mined product. . <br />The water. used in the batch plant and used for on-site dust suppression. will be <br />produced from a new alluvial well... Since the water consumed by dust suppression and <br />concrete batching is considered 100 percent consumptive fhe total. pumping from the well will <br />be limited. to 27.86 acre-feet annually. <br />This plan anticipates dry mining of the Bemhardt Pit. The anticipated 4,2 acres of <br />exposed groundwater consists of 0.2 acres of dewatering trenches and. a 4-acre silt pond located <br />more than f 00 feet from the. Big Thompson River... To provide the security of a permanent, <br />renewable source of replacement water,. 3.5 shares of Big Thompson & Platte River Ditch are <br />hereby dedicated. to this plan and made appurtenant to the tract of land. where the gravel pit will <br />be located,. until. a permanent augmentation plan for the gravel. pit has been adjudicated. These <br />shares were found to be adequate to cover the depletions from evaporation. that would occur if <br />the dewatering. process was stopped and. the 20-acre pond was allowed to fill. A copy of this <br />approval letter and a copy of the stock certificate shalt be recorded with. the Weid County Clerk <br />and Recorder's. Office.. During the term of this substitute water supply plan the 3.5 shares of <br />Big.
