SNOWCAP COAL COMPANY <br />SEDIMENT POND P-13 <br />In accordance with Rule 4.05.9(14), each impoundment will be inspected during <br />construction under the supervision of, and certified after construction by, a qualified <br />registered professional engineer. This certification is for the construction of Sediment <br />Pond P-13 which is located at the reclaimed North Portal. The pond was constructed <br />during May through July 2002. <br />The construction of the impoundment was supervised by the undersigned. I have a wide <br />variety of experience in the construction industry and have supervised the construction of <br />numerous impoundments. <br />The pond was dry during the final inspection performed July 26, 2002. Nothing was <br />observed during the inspection that would indicate the pond has a potential for failure. <br />There was no appearance of erosion, instability, structural weakness or other hazardous <br />conditions. There are no aspects which might affect stability and there is no required <br />maintenance. The design calculations for the pond are <br />contained in Volume 5, Appendix 14-6, pages 14-6-53 through 14-6-63.
