<br />BILLING PROCEDURE <br /> <br />A statement showing the cumulative charges will be forwarded to the following address for approval: <br />USDA Forest Scrvice <br />Medicine Bow-Rout[ National Forest <br />Attn: Loren Ebner, Convecting Officer <br />925 Weiss Drive <br />Steamboat Springs, CO 80487 <br />(970)870-2207 <br />Invoices from Big Creek Ranch to the Forest Service shall include the following information: <br />I. Blanket Purchase Agreement Number <br />2, Date <br />3. Sig Creek Ranch's name, taxpayer identification number, address, and phone number and the address to where <br />payment is to be remitted. <br />4, Itemization of charges, including dates, quantities, charges, and the name of the Forest Service employee who <br />ordered the materials. <br />SURFACE ALTERATIONS AND ACCESS <br />Forest Service may clear brush and undergrowth, incompliance with the "Construction Material Limited Impact (110} <br />Operation Reclamation Permii' (referted to hereafter as "I10 Permit") issued by the State of Colorado, Division of Minerals <br />and Geology, from such portions of the premises as may be reasonably necessary to explore far materials or locate pits, <br />quarries, and stockpile areas. In order to obtain access to the premises, and to cagy on its operations hereunder, the Forest <br />Service shall have the right to make use of all the roadways presently existing on the premises and will otherwise confine it's <br />operations to the location defined in Exhibit A. <br />INSURANCE & DAMAGES <br />It is understood by the Big Creek Ranch that the Government is self-insured. Claims against the Forest Service by Big Creek <br />Ranch will be handled in accordance with the Federal Acquisition Regulations. <br />REMOVAL OF IMPROVEMENTS AND EQUIPMENT <br />All improvements and equipment placed on the premises by the Forest Service shall remain the property of the Forest <br />Service, and Forest Service wil! remove such property upon expiration or termination of this agreement. <br />PROPERTY IRRIGATION <br />The Forest Service will not for any reason obstruct, impede, diminish, or otherwise adversely affect the Flow of water in any <br />irrigation ditch or the watercourse transversing the premtses during the term of this agreement without prior written consent <br />of the Big Creek Ranch. <br />USE OF PREMISES BY STATE LINE RANCH <br />The Big Creek Ranch shall have the right to use at any time and for any purpose. not inconsistent with the rights of the Forest <br />Service hereunder, such portions of the premises not being actually and/or physically used by the Forest Service for the <br />extraction and mining operations. <br />~~3 <br />
