Please be advised that this application may be <br />deemed inadequate- and your application may be denied on April 27, 1999 unless the following adequacy <br />review items are addressed to the satisfaction of the Division. <br />1) ExhibirA--LegalDescription <br />The statement is made in this ExhibiC that "Where lands have been excepted into the permit boundary, platted <br />boundaries, shown in Exhibit A -Legal Description, will be honored anti? ownership of the lands excepted <br />into the boundary have been validated :' <br />Please note that the Division can not approve an area as part of a permit wt,ere the applicant does not have <br />proof of legal right-of-entry. If legal right-of-entry is not provided to the Division prior to the approval of the <br />permit these areas will not be considered as part of the permit area. The applicant can add these areas after <br />permit approval by submitting an amendment application. <br />2) Exhibit D -Mining Plan <br />The applicant makes reference to a "later, Exhibit C-3: Protection of Existing Facilities Plat". When does the <br />applicant plan to submit this Exhibit? <br />3) Exhibit E -Reclamation Plan <br />a) Under 3.1.6(x) the applicant states that "The applicant has filed for a temporary substitute supply plan <br />[a-k.a. augmentation plan] from the Colorado Division of Water Resources -Office of the State Engineer:' <br />Until this plan has been approved by the Division of Water Resources the applicant cannot expose <br />groundwater unless they wish to post sufficient bond to backfill the pit to two feet above the ground water <br />table. <br />
