David Holm, Duector <br />Water Quality Control Division <br />Colorado Department of Public Health and Environment <br />4300 Cherry Creek Drive South <br />Denver, Colorado 80246-1530 <br />Re: Draft CDPS Permit No. CO-0045675 <br />Response to Public Comment <br />Deaz Mr. Holm: <br />This letter and its attachments aze submitted on behalf of Battle Mountain Resources Inc. <br />and Battle Mountain Gold (collectively "BMG") in response to issues framed in <br />comments received during the public comment period for the above referenced draft <br />permit and the subsequent public meeting held in San Luis, Colorado on June 27, 2000. <br />At the outset we note that virtually all of the written and oral comments received to date <br />on the draft permit aze predicated upon the commenter's incomplete or inaccurate <br />understanding of the record which is before your office and the Division of Minerals and <br />Geology ("DMG) with respect to BMG's response to the West Pit water quality issues. <br />As we have stated on numerous occasions, BMG believes it is imperative that your office <br />and DMG effectively communicate and coordinate their actions with respect to the San <br />Luis facility. Effective coordination will assure that BMG's response efforts aze <br />consistent with the requirements of both agencies and that the public can readily ascertain <br />that the water quality issues aze being appropriately addressed through the applicable <br />statutes and regulations administered by those respective agencies.
