Schuett <br />January 27, 1987 <br />Page 2 <br />North Weld County Water District is named as the source of drinking and <br />sanitary water for the operation and a letter of commitment has been pro- <br />vided. The application does not mention using water for dust control or other <br />mining purposes. Will water be needed for the operation, and if so, what will <br />be the source of supply? Weld County will not be able to use water in the pit <br />for the mining operation unless replacement water for the additional consump- <br />tive use is included in the plan for augmentation. <br />Unless a plan for augmentation is developed to replace the water loss to <br />the system due to evaporation, the operation will injure existing water <br />rights. Therefore, we cannot recommend approval of the permit until the <br />applicant is capable of mitigating the injury that will be caused by the <br />project. Further, we will order Weld County to cease operations if our Water <br />Commissioner determines ground water is being exposed without a well permit or <br />there is determined to be a wasteful use of ground water occurring. <br />Sincerely, <br />Fes' ~ <br />Hal D.
