Cattany <br />Division Director <br />Natural Resource Trustee <br />The Division of Minerals and Geology has completed review of the sediment pond <br />inspection reports for the 1BI 2"d and 3rd quarters of 2004 for the New Elk Mine. Data <br />reported is consistent with observations made during field inspections. The 3`d quarter <br />reports document that the gate on pond 7 is maintained in the closed position. Please <br />be aware that if, and when, pond water is discharged manually via opening of the outlet <br />gate, the effluent must meet the most stringent effluent limitations as stated in your <br />CDPS discharge permit. Minor erosion at the intersection of the emergency spillway <br />and primary discharge channel at pond 8 are also noted, as also identified in DMG <br />inspection reports. The pond inspection reports meet the requirements of Rule <br />4.05.9(17) and Rule 4.05.9(21). <br />We have no further questions at this time. Please submit future reports to the Division <br />within 30 days following the end of the previous calendar quarter.
