Colorado Mined Land Reclamation Board Hearing Process:
Typically, any application fora ! 12 Regular Operation permi[ or an amendment to a ] 12 Rewlar Operation permit
requires a heating before the Mined Land Reclamation Board when there is a written objection. However, prior to the
Formal Board Hearing, several other hearings mus[ occur prior to the Formal Board Hearing.
• The Informal Conference:
The fast of the three hearinss in the process is the Informal Conference. If there aze objections-or at the request of the
applicant or local board of county commissioners -the Division will schedule an informal conference among the
parries. The informal Conference is held after the close of the required comment period, which is about 50 to 60 days
from the date an application is considered filed with the Division.
The purposes of the informal conference are to:
• Explain the three hearing process to the parties
• Identifv the issues
• Identify the parties
• Determine what issues have been resolved
• Determine if any parties want to withdraw
The Pre-hearing Conference: ~
The second hearing is the Pre-hearing Conference. It can occur no sooner than te7m days afer the Division has made iu
recommendation to approve or deny the application for a permit or amendment. However, it must also occur at least
5ve (5) days prior to the Formal Board Hearing. The Pre-hearing Conference is usually conducted by a member of the
Mined Land Reclamation Board. The Division is required to mail its recommendation to al] parties prior [o the Pre-
hearing Conference.
The purposes of the Pre-hearing Conference aze to:
• Recommend the issues the full Board should consider '
• Determine the lists of witnesses and exhibits to be presented by the parties at the Formal Public Hearing
• Determine the amount of time each party will have to make their presentations at the Forma] Public
Hearing
• Prepare a Draft Board Order that will be rued to conduct the Formal Board Hearing
The Formal Board Hearing:
The Formal Board Hearing must be held prior to the automatic approval date for the permit application or the
amendment. At the Formal Board Heazing, the fast order of business is for the Board to adop[ the Drafr Board Order.
Parties may object to the Drafr Board Order and seek revisions. Once the Draft Board Order is adopted, the Formal
Board Hearing begins.
On occasion, an operator may have a consultant represent the operator or company. In order to represent the applicant
or operator, the Board and the Attorney General's Office have requested that consultanu complete a notarized form of
