These discharges were in the form of seeps that daylight at the toe of the waste rock pile at the <br />Level 6 Pad and flow into Deadman's Gulch. Recent water quality monitoring in Deadman's Gulch <br />indicate a negative impact on Deadman's Gulch originating at the mine site. The discharges from the <br />seeps at the mine site are in direct violation of the Water Quality Control Act, which requires that all <br />discharges of pollutants to state waters must be permitted: <br />§25-8-501(1) C.R.S., which states in part, "No person shall discharge any pollutant into any state <br />water from a point source without first having obtained a permit from the division for such <br />discharge...." <br />Within thirty (30) calendar days of this letter, please submit to the Division an application for permit <br />coverage under and Individual Industrial Wastewater (Process Water) Discharges for Metal Mining. A <br />copy of this permit application is included in this letter and can also be accessed on the Division's <br />website at http://www.cdphestate.co.us/wq/PermitsUnit/IndustriaUindex.html. <br />The issuance of this Compliance Advisory does not limit or preclude the Division from pursuing its <br />enforcement options concerning the above violations. The Division is currently evaluating the facts <br />associated with the above-described violations.
