P13 6603023 <br />Mined Land Reclamation RETURN RECEIPT REQUESTED <br />423 Centennial Building <br />1313 Sherman Street <br />Denver, Colorado 80203 <br />Re: Daniels Sand Pit No. 2 <br />Dear Mr. Schmeiding: <br />On behalf of our client, Transmix Concrete Company, a Colorado <br />Corporation, this letter is a request for release of the <br />land stabilization and reclamation agreement made by Transmix <br />Concrete Company, dated August 27, 1974, in favor of the <br />Commissioner of Mines and Division of Mines, a copy of which <br />is attached hereto as EXHIBIT A. Pursuant to that agreement, <br />a bond was executed, dated December 26, 1974, and according <br />to our insurance agent, it is still in full force and effect. <br />A copy of the bond is attached hereto as EXHIBIT B. <br />The grounds for this request for release would be the issuance <br />of Daniels Sand Pit No. 2, Permit No. 73-7, which was issued <br />by the Mined Land Reclamation Board on January 7, 1981, with <br />a security bond in the sum of Seventy Five Thousand ($75,000.00) <br />Dollars, submitted pursuant to the terms of the permit. <br />We do not feel there is any just cause for having a duplicate <br />bond, and as a matter of law the land stabilization agreement <br />with the Division of Mines should be superseded by Permit <br />No. 73-7. <br />Please advise the undersigned whether this is a matter that <br />requires formal board hearing and presentation of position. <br />Respectfully, <br />GSB/bjw <br />EvA GS <br />~, F' <br />_, ~! <br />COtt Br1gQS <br />Enclosures: EXHIBIT A <br />EXHIBIT B <br />cc: Trans^ix Concrete Company <br />r <br />~~ ~ '/~ <br />f LL <br />cc: Carl F.
