Dear Mr. Schmeiding:
On behalf of our client, Transmix Concrete Company, a Colorado
Corporation, this letter is a request for release of the
land stabilization and reclamation agreement made by Transmix
Concrete Company, dated August 27, 1974, in favor of the
Commissioner of Mines and Division of Mines, a copy of which
is attached hereto as EXHIBIT A. Pursuant to that agreement,
a bond was executed, dated December 26, 1974, and according
to our insurance agent, it is still in full force and effect.
A copy of the bond is attached hereto as EXHIBIT B.
The grounds for this request for release would be the issuance
of Daniels Sand Pit No. 2, Permit No. 73-7, which was issued
by the Mined Land Reclamation Board on January 7, 1981, with
a security bond in the sum of Seventy Five Thousand ($75,000.00)
Dollars, submitted pursuant to the terms of the permit.
We do not feel there is any just cause for having a duplicate
bond, and as a matter of law the land stabilization agreement
with the Division of Mines should be superseded by Permit
No. 73-7.
Please advise the undersigned whether this is a matter that
requires formal board hearing and presentation of position.
