Sandy Marek <br />Colorado Department of Health <br />Division of Administration <br />4270 E. 11th Avenue <br />Denver, Colorado 80220 <br />P.e: Colorado Mined Land Reclamation Division (CMLRD) Meeting with <br />Representatives of Wyoming Fuel Company (WFC) on May A, 1988 in Regard to <br />Plans for Mine Water Treatment at Golden Eagle Mine <br />Dear Mrs. Marek: <br />This letter is an attempt to summarize CMLP.D understanding of the agreements <br />reached with WFC during the above referenced meeting and to estimate the time <br />required to honor these agreements. <br />Present at the meeting were Dave Stout (WFC), Jerrv Koblitz (WFC Consultant), <br />Bob Liddle (CMLP,D1, Tony Waldron {CMLRD), and Jim Stevens (CMLP.D). As <br />background to the discussion, WFC described the tentative agreement worked out <br />between WFC and DOH in your recent meeting, ie. two "demonstrations" were to <br />be allowed to determine if Golden Eagle NPDES permit requirements for the mine <br />water could be met. The first or Phase 1 demonstration would be two weeks in <br />length, involve splitting mine water between two systems, ie. using Ponds 2, <br />2A, 2B (in series) and Pond 3, and would not involve chemical treatment of the <br />water. The second or Phase 2 demonstration would be undertaken if Phase 1 <br />proved unsuccessful, involve 4 weeks, use both systems, but include the use of <br />NALCO 7883 flocculant. During these demonstrations, WFC would extensively <br />monitor the disc harae but not be required to meet effluent Limitations. <br />Apparently as a result of your call to David Stout following our phone <br />conversation on May 3, 1988, he was aware and attempted to address the <br />Division's concern with modifying the existing CMLRD cessation order to allow <br />WFC to use the Nalco 7883 flocculant in the Phase 2 demonstration, <br />particularly without a better understanding of the makeup of the entire <br />treatment system. As was explained to WFC, the Division actually lacks any <br />specific means within its rules to approve such a facility, even on a <br />temporary basis, without revising the mine permit and providing for public <br />comment. WFC, therefore, proposed to submit the demonstration pro.iect to the <br />Division as a technical revision by about May 12, 1988. On its part, CMLRD <br />committed to make every reasonable effort to hasten the review and approval of <br />this revision so as to reduce the delay in completing the demonstration.
