Ms. Cheryl Signs Page 3 <br />Barlow Pit M-74-092 <br />May 31, 2007 <br />recharge accruing from any of the Riverside's shares for the applicant's 4.0 RRLC private rights. This <br />trade would maintain the historical return flow pattern. By the letter dated January 19, 2007, Riverside <br />Irrigation District will consider trading reservoirwater owned by Dom Ready Mix for recharge credits owned <br />by the Riverside Irrigation District to cover depletions from Barlow Pit. This proposed swap of reservoir <br />water for recharge accretions was confirmed for the period of June 2007 through May 2008 by two Water <br />Orders dated June 24, 2007. One Water Order indicated that Dorn Ready Mix released 4.0 RRLC private <br />rights to the Riverside Irrigation District. A second Water Order indicated the Riverside Irrigation District <br />committed recharge credits to cover depletions from Barlow Pit from June 1, 2007 through May 31, 2008. <br />The Water Order amounts reflect the actual replacement requirements based on the currently exposed <br />ground water at the Barlow Pit site of 11.4 acres, which results in estimated evaporative depletions of <br />11.06 acre-feet per year. <br />This plan is approved based on the use of Riverside's recharge credits as the source of <br />replacement water. If direct releases from Riverside Reservoir are to be used instead of Riverside's <br />recharge credits, the Applicant shall first notify the division engineer, water commissioner and the SEO <br />and provide an updated table that will also include the return flow obligations. <br />The monthly lagged stream depletions and the corresponding monthly recharge accretion credits <br />are shown on the attached Table 1. Monthly amounts for evaporation, ET credit, and product moisture <br />loss are shown on the attached Table 2. <br />I hereby approve this substitute water supply plan in accordance with C.R.S. § 37-90-137(11), subject <br />to the following conditions: <br />1. Unless otherwise revoked or modified, this plan shall be valid for the period of June 1, 2007 <br />through May 31, 2008. This plan will be extended until May 31, 2009, if a Water Order for the use <br />of Applicant's Riverside Reservoir water for the period of June 2008 though May 2009 is provided <br />to the division engineer, water commissioner and the SEO prior to May 31, 2008. <br />2. If this plan will not be made absolute by a water court action by the plan's expiration date, a <br />renewal request must be submitted to this office with the statutory fee (currently $257) no laterthan <br />April 15, 2008 or April 15, 2009 subject to the requirements of condition 1. <br />3. Well Permit No. 61944-F was issued for 10.8 acres of exposed ground water in accordance with <br />C.R.S. § 37-90-137(2) and (11), thus the Applicant is required to obtain a new well permit for the <br />expansion of the exposed surface area of the gravel pit in accordance with C.R.S. § 37-90-137(2) <br />and (11) and this plan. The provisions of Colorado Revised Statute 37-90-137(2) prohibits the <br />issuance of a permit for a well to be located within 600 feet of any existing well, unless the State <br />Engineer finds that circumstances so warrant after a hearing held in accordance with the procedural <br />rules in 2CCR402-5. This hearing may be waived if you are able to obtain statements from the <br />owners of all wells within 600 feet, verifying that they have no objection to your use of the proposed <br />well. Should a new well permit be denied for reasons of 600 foot spacing, or any other legitimate <br />reason, approval of this substitute supply plan may be cancelled. <br />4. The total surface area of the groundwater exposed at the Barlow Pit site after December 31, 1980 <br />must not exceed 35.75 acres resulting in 34.42 acre-feet per year of evaporative loss. <br />5. The total amount of water used in the concrete batch plant and withdrawn from well permit no. <br />2104-F shall not exceed 7.31 acre-feet per year and the total product mined at the Barlow Pit site <br />shall not exceed 100,000 tons per year resulting in 2.94 acre-feet per year of water lost with the <br />mined product. <br />
