Recent CDOT studies indicate that the traffic count on ITighway 9 adjacent to the proposed mice has increased 25% from 1992 through 1995. Increased traffic generated by the proposed mine end ancillary operations could create both a negative health anti safety impact on the public as well as additional costa to the public to deal with these impacts over the Life ofthe proposed permit (50 years). 13. Many current vehicle users of applicants existing operation (Love Pit) pose significant safety risks to other users of FTighway 9 adjacent to the present mine. What provision has been made to eliminate such safety risks, e.g., overloaded trucks from mining operation using Highway 9; trucks outside CDOT motor carrier regulations obtaining materials from proposed mine and subsequently utiliang I~Lghway 9, etc.? 14. Certain issues raised by water quality specialists of the Northwest Colorado Council of Governments should be addressed. These issues are identified in the memo from Lane Wyatt dated July 12, 1996, a copy of which is attached for your cosienience. 15. Finally, this Board should require the sampling of fill material at the Love Pit to determine compliance with the existing permit. Based on the foregoing, it is the position of the undersigned that the requested permit should be denied until at least each of the above referenced items is adequately provided for.
