Sustwtsion, Revocation, or Termination of Permits Sv the Division (rnntinuedl <br />iii. Requiremenss of Section 6.16.0 of the Regulations for the State Dischazge Permit System have been met, and <br />iv. Requirements of public notice have bem met. <br />d. Permit modification (except for minor modifications), termination or revocation and reissuance actions shall be <br />subject to the rrquirements of Sections 6.6.2, 6.6.3, 6.7.0, 6.8.0 and 6.16.0 of the Regulations for the State <br />Discharge Permit System. The Division shall act oa a permit modification request, other than minor modifications <br />requesss, within 180 days of receipt thereof. F~tcept for minor modifications, the terms of the existing permit <br />govern and arc enforceable mtil the newly issued permit is formally modified or revoked and reissued following <br />public notice. <br />e. Upon consent by the permittee, the Division may make minor permit modifications without following the <br />rcquiremenss of Sxtioas 6.6.2, 6.6.3, 6.8.0, and 6.16.0 of the Regulazioos for the State Discharge Pctmit System. <br />Minor modificazions to permits are limited to: <br />i. Correcting typographical errors; or <br />ii. Increasing the frequency of monitoring or reporting by the peratinee; or <br />iii. Changing an interim date in a schedule of compliance, provided the new date of compliance is not more than <br />120 days after the date specific in the existing permit and does no[ interfere with attainment of the final <br />compliance date requirement; or <br />iv. Allowing for a transfer is ownership or operational comrol of a facility where rite Division determines thai +~~ <br />other change in [he permit is necessary, provided thaz a written agreement containing a specific daze for trattsfe <br />of petmi[ responsibility, wvetage and liability between the torten[ and new petmittees has ban submined to U <br />Division; or <br />v. Changing the con~n„frion schedule for a ditchhazger which is a crew source, but no such change shall affect a <br />discbarger's obligation to have all pollution control equipment installed and in operation prior to discharge; or <br />vi. Deleting a point source ouffall when the discharge from thaz ouffall is terminazed and does not result in <br />discharge of pollutants from other ouffalls except in accordance with permit limiss. <br />f. When a permit is modified, only the conditions subject to modification are reopened. If a permit is revoked and <br />reissued, the entire permit is reopened and subject to revision and the permit is reissued for a new term. <br />g. The filing of a request by the permittee for a permit modificazion, revocation and reissuance or termination does ~+~ <br />stay any permit condition. <br />h. All permit modifications and reissuanees are subject to the antibacksliding provisions set forth in 6.11.0 (5) throng <br />(9)• <br />6. Oil and Harardout Substance Liability <br />Nothing in this permit shall be construed to preclude the institution of any Legal action or relieve the permittee from at <br />responsibilities, liabilities, or penalties to which the petmittee is or may be subject to under Section 311 (Oil and <br />Hazardous Substanm Liability) of the Clean Wattt Ace. <br />
