Availability of Reports <br />Except for data determined to be confidential under Section 308 of the Federal Clean Water Att and Regulations for the <br />State Dischazge Permit System 5 CCR 1002-2, 6.6.4, all reports prepared in accordance with the terms of this permit <br />shall be available for public inspec[ion at the offices of the Division and the Environmental Protec[ion Agency. <br />The name and address of the permit applicant(s) and permittee(s), permit applications, permits and effluent data shall no[ <br />be considered confidential. Knowingly making false stazement on any such tcpon may result in the imposition of <br />criminal penalties as provided for in Section 309 of the Federal Clean Water Act, and Section 25-810 C.R.S. <br />5. Modification, Suspension. Revocation. or Termination of Permits By the Division <br />The filing of a rrquest by the permiaee for a permit modifica[ion, revocation and reissuance,termination or a notification <br />of planned changes or anticipated noncompliance, does not stay nay permit wndition. <br />a. A permit may be modified, sttspended, or terminated in whole or in pan during its term for reasons determined by <br />the Division including, but not limited to, the following: <br />i. Violazion of any terms or conditions of the permit; <br />ii. Obtaining a permit by misrepresentazion or failing to disclose any fact which is material to the granting or denial <br />of a permit or to the establishmem of terms or conditions of the permit, of <br />iii. Mazerially false or inar.,nare eratnn'n(S or informaion in the permit application or the permit. <br />iv. A derr•rm•"ation thaz the permitted activity endangers human health or the classified or existing uses of state <br />wazets and can only be regulated [o acceptable levels by permit modifications or termination. <br />b. A permit tray be modified in whole or in pan for the following carues, provided that such modification complies <br />with the provisions of Section 6.11.0 of the Regulations for the State Discharge Permit System: <br />i. There are mazerial and substantial alteruions or additions to the permitted facility or activity which occurred <br />after permit issuance which justify the application of permit conditions thaz arc different or absent is the existing <br />permit. <br />ii. The Division has received new iafortrtarion which was not available az the time of permit issuance (other than <br />revised regulations, guidance, or test methods) and which would have justified the application of different <br />permit conditions az the time of issuance. For permits isnted to new sources or new dischargers, this cause <br />includes information derived from effluent testing required under Section 6.5.7(5) of the Regulations for the <br />State Discharge Permit System. This provision allows a modificazion of the permit to include conditions thaz <br />arc less stringent than the existing permit only to the extent allowed under Settion 6.11.0 of the Regulations fox <br />the State Dischazge Permi[ System. <br />iii. The standards or regulazions on which the permit was bated have been changed by promulgazion of amended <br />standards or regulations or by judicial decision after the permit was issued. Permiu may be modified during <br />their terms for this cause only as follows: <br />(A) The permi[ condidan requested ro be modified was based oa a promulgated effluea[ limitation guideline, <br />EPA approved water quality standazd, or an effluent limitation set forth in 5 CCR 1002-3, § 10.1.0 et se <br />and <br />
