<br />PART I <br />Page No. 3 <br />Permit No. COG-850000 <br />A. COVERAGE UNDER THIS PERMTI' <br /> <br />1. This general permit authori>ec discharges thaz consist entirely or principally of precipitation-induced surface runoff from <br />coal mining and processing operations including foadouts, while active mining is occurring or during reclamazion prior to <br />final bond release, imo wazers of the State of Colorado. If additional sources which dte Division determines to be minor <br />in nature such az selected mine wazer, preparazion plan water, spoils spring water or other waztewazer may be <br />discharged, these sources may be covered under this permit az the Division's discretion providing thaz such waztewazer <br />would not require effluem limitations and/or monitoring requirements other than those contained in this permit. Such <br />determinations will be made on a case-by case bazis upon review of the permit application and any additional relevant <br />information. If discharge from one or more of the above listed sources require additional limitations and/or monitoring <br />requirements, an individual permit may be requited. Multiple dischage points from one facility may be authorized <br />through this permit providing all meet these criteria. <br />2. In order to apply for certification under this general permit, the owner, operator, and/or authorized agent of the subject <br />facility shall submit by certified mail or hand delivery, the completed Coal Mining Wastewater Discharge Application <br />(famished by the Division) which generally requires the following infortoazion (az a minimum): <br />a. Name, address, and descriptive location of the facility; <br />b. Name of principal in charge of operation of the facility; <br />c. Name of immediate receiving waters, (including irrigazion ditches, intermittent streams and dry drainage, az <br />applicable); <br />d. Description of the type of activiry(ies) resulting in the discharge, including the anticipated dtrrazion of the activity <br />and/or the d'rsrharge, anticipazed volume and rare of discharge, and the source(s) of water to be discharged; <br />e. Description of any waztewazer trar~,rnt system(s) and terycldreuse utilized; <br />f. A topographic 8Yr z 11 inch map showing the general geographical location of the facility and any nearby landfills, <br />mine or mill tailings, or a~ other known or suspected sourar of pollutants; <br />g. An 8Yr z 11 inch sketch of the facility showing all structures, outfalls and receiving waters, as well as storage ' _ <br />locations of any ptxrolenm or chemicals on site; and <br />h. A chemical analysis of the wazer to be discharged. R no water is available, this shall be indicated. <br />If the discharge is to a storm sewer system, ditch or other manmade conveyance, approval from the owner of the system <br />must be obtained prior to discharge. <br />At leazt 30 days prior to the anticipazed date of discharge, such information shall be submitted on the application form <br />to: <br />Colorado Departmrnt of Public Health and Environment <br />WQCD-PE-B2 <br />4300 Cherry Creek Drive South <br />Denver. CO 80222-1530 <br />The Division shall have up to thirty days after receipt of the above information m request additional data or deny the <br />authorization to discharge. Upon receipt of additional infotmaion, the Division shall have an additional 30 days to issue <br />or deny authorization to discharge. If the applicant does not receive a request for additional informazion or a notification <br />of denial from the Division within thirty days, authorization to discharge in accordance with the terms and conditions of <br />Ne permit shall be deemed granted. <br />If the Division determines that a new facility does not fall under the authority of the general permit, then the information <br />tueived will be processed for an individual permit and discharge will not be allowed until 180 days after the daze the <br />application waz received. The applicant shall be notified of such a determin=rion. If during the renewal process, the <br />Division determines that a facility no longer qualifies for the general permit, the facility will be allowed to discharge <br />under the general permit until an individual permit is issued. <br />3. Authorization to discharge under this general permit shall expire on Juae 30. 2002. The Division must evaluate this <br />general permit once every five years and must also recertify all applicants' authority to discharge undo the general <br />permit az such time. Therefore, a petmittee desiring continued coverage wader the general permit must reapply by <br />Jaauarv 1. 2002. The Division will determine if the applicant continues to operate under arms of the general permit. <br />
